Crowder presides over trial in case against Boy Scouts and local Council

Madison County Circuit Judge Barbara Crowder is presiding over a case that went to trial today involving a camper’s injury claim against the Lewis & Clark Council of the Boy Scouts of America.

Plaintiffs John and Brenda Gremli sued in 2011 claiming that while he was camping on July 22, 2010, a dead tree fell on John Gremli while he was sleeping in a tent at Camp Warren Levis in Godfrey.

The Gremlis allege that the Lewis & Clark Council failed to properly inspect and remove dead trees from campsites and failed to maintain the campsites in a safe condition. Boy Scouts of America also is named as a defendant. It has unsuccessfully argued for dismissal, saying it does not have local control over the premises or volunteers.

Motions to dismiss and for summary judgment were dismissed in March by Circuit Judge Dave Hylla, who stated that questions of fact remain.

The couple claims that injuries to John Gremli’s right leg were so severe that the leg had to be amputated above the knee. They are seeking in excess of $150,000 in damages.

They are represented by Robert Gregory of East Alton.

The defendants are represented by Bradley Hansmann and Kyle Christopher Oehmke of Brown & James in St. Louis.

Prospective jurors were being interviewed today.

Until recently, Crowder has not presided over major civil litigation cases since being removed from the court’s asbestos docket in December 2011.

Crowder was reassigned by former Chief Judge Ann Callis to the chancery, eminent domain and miscellaneous remedies dockets after it was revealed she had accepted $30,000 in campaign contributions from the area’s top three asbestos firms after making a ruling that was favorable to them. Crowder later returned the donations.

Callis stepped down from the bench last month to pursue a bid for Congress. In her place, Hylla was elected chief judge.

Hylla, who had presided over the Gremlis’ case, transferred it to Crowder on May 6. Hylla has also assigned at least one other major civil case to Crowder. He has been contacted to comment on what appears to be a new role for Crowder.

The case is Madison case number 11-L-021.

Risk manager for local BSA Council testifies about tree in personal injury trial

A Boy Scout volunteer who serves as a risk manager for a local Council testified Tuesday that before a Camp Warren Levis campsite was allowed to be used, routine inspections showed no signs of tree rot along its perimeter.

In a personal injury trial under way in Madison County, Larry Todoroff also said that an approximate 70 foot tree that fell on adult camper John Gremli’s tent while he was sleeping on July 22, 2010 – and which resulted in his above the right knee amputation  - had shown no signs of problems with its leaves, bark or limbs.

After it fell, however, the tree was observed as rotten approximately two feet below its base and five feet above its base, according to testimony.

Todoroff, along with John Gremli and his wife Brenda Gremli took the witness stand in Circuit Judge Barbara Crowder’s court in a case against the Lewis & Clark Council which operates the Godfrey campsite and the Boy Scouts of America (BSA).

The Gremlis claim the defendants failed to monitor the safety of the campsite and to remove dead and dying trees that were hazards.

Gremli, 54, is fitted with a prosthetic device and walked with a cane slowly and with a severe limp to and from the stand.

Under questioning from defense attorney Bradley Hansmann of St. Louis, Todoroff said he is a former Alton High School coach and principal who has been with the BSA organization continuously for 62 years, at first as a Scout at age 8.

He said the job of the Council’s risk management committee on which he serves is to make sure that BSA safety standards are adhered to. “Highly specialized” teams of volunteers, usually veteran Scouts with professional skills, inspect sites to be sure that “detriments” are taken care of, he said.  Sites are “double checked” in post- and pre-camping inspections for problems, he said.

Plaintiff’s attorney Robert Gregory of East Alton, tore into Todoroff’s testimony saying that a safety inspection conducted before the fallen tree incident was not strictly adhered to. He displayed on a screen a copy of a report which stated what type of experts are required to conduct inspections, and said that not all of those experts, such as public health and medical personnel, signed off on a report preceding Gremli’s injury.

Brenda Gremli testified that her husband has had to undergo multiple surgeries and extensive rehabilitation, and that despite his limited mobility and the problems created by that, he remains “positive, upbeat.”

“That has made that part of my life easier,” she said.

She also said she is concerned about her husband’s long term health care. “What will happen at age 64, 74? Will he be wheelchair bound?”

In their suit, the Gremlis seek in excess of $150,000 in damages.

Godfrey quick cash loan store targeted in class action

gavelAn Alton man claims a Godfrey quick-cash loan store illegally notified his employer of its intent to garnish his wages.

Mark A. Lewis, individually and on behalf of a group, filed a class action lawsuit May 31 in Madison County Circuit Court against Advance America, Cash Advance Centers of Illinois Inc.

Lewis says he signed a contract with Advance America in July 2010 that allowed for assignment of his wages if he failed to make proper payments on the loan.

In May 2012 Advance America faxed to Lewis’ employer a notice of intent to assign wages, according to the complaint. Lewis contends that violates the Illinois Wage Assignment Act because the notice should have been served directly to him.

Lewis claims Advance America has served similar improper notices of wage assignment to employers of other customers. He asks to be appointed as representative for the class and seeks more than $50,000 in damages plus court costs.

Attorney Shari L. Murphy of Wood River represents the plaintiffs.

New D.J.’s Bar in Alton sued by women claiming they were attacked

Two Madison County women say they were hurt when they were attacked at an Alton bar.

Jamie Farmer-Sparks and Denise Sparks filed a lawsuit May 31 in Madison County Circuit Court against New D.J.’s Bar and Grill Inc., Debra G. Lovell, Cynthia N. Allen and Charles E. Hall.

Jamie Farmer-Sparks and Denise Sparks were customers at New D.J.’s Bar and Grill in June 2012, according to the complaint. Allen and Hall were also inside the College Avenue bar and were allegedly intoxicated. Jamie Farmer-Sparks and Denise Sparks claim they were attacked without provocation and beaten up by Allen and Hall.

Jamie Farmer-Sparks and Denise Sparks accuse the bar and its owner, Lovell, of negligence for allowing Allen and Hall to become intoxicated and aggressive.

also accuse the alleged attackers of negligence. Jamie Farmer-Sparks and Denise Sparks ask for $400,000 in damages for medical expenses, lost wages and court costs.

Passenger sues over Route 157 accident in Collinsville

A man is suing the driver of a car he was riding in when it crashed into another vehicle at Collinsville intersection.

Darin Kinsolving filed a lawsuit against Henry Carle June 7 in Madison County Circuit Court.

Kinsolving says he was a passenger in a Cadillac being driven by Carle in April 2012. Carle was heading west on Illinois Route 157, according to the complaint. At the intersection of West Main Street Carle allegedly tried to turn left in front of oncoming traffic.

Kinsolving claims Carle did not turn on a turn signal and crashed into a car being driven east by Michael C. Anderson.

Kinsolving contends he was hurt in the crash and accuses Carle of negligence. He asks for more than $50,000 in damages for medical expense, loss of income and court fees.

CVS accused of dispensing wrong muscle relaxer

A Madison County man and his family are suing an Alton pharmacy for giving him the wrong muscle medication.

Marvin D. Miller, Marvin D. Miller Jr. and Peggy Hansen filed a lawsuit June 7 in Madison County Circuit Court against CVS/Pharmacy LLC and pharmacist Jane Doe.

According to the complaint, Miller Sr. was prescribed the muscle relaxant Robaxin in August 2011. However, when he took his prescription to the College Avenue CVS Pharmacy the pharmacist on duty allegedly filled it with Cyclobenzaprine, the wrong muscle relaxer. Miller Sr. claims he became sick after taking the medicine he was given.

Miller Sr. accuses the pharmacy and pharmacist of negligence. His children are suing the defendants for loss of consortium. They ask for more than $300,000 in damages for medical expenses and court costs.

Attorney Allan L. Napp of Alton represents Miller and his family.

Two judicial groups elect Crowder to board of directors

Madison County Circuit Judge Barbara Crowder has been elected to the board of directors for two judicial organizations, the chief judge’s office announced Thursday.

In a new release, Chief Judge Dave Hylla’s office said the Illinois Judges Association (IJA) and the Illinois Judges Foundation (IJF) this month elected Crowder to their boards.

Crowder will serve a three-year term on the IJA’s board of directors, which will mark her fourth election to the board, according to the release.

The IJA is made up of about 1,250 active and retired state judges and provides education and other services to its members and the public. The IJF is a charitable organization that funds legal-related programs and provides scholarships to law students.

The IJF also offers high school programs, such as “7 Reasons to Leave the party Early” and “Courtroom in the Classroom,” both of which the release notes Crowder has presented in Madison County schools.

Crowder, a judge since 1999, was elected to both boards at the groups’ annual meetings this month.

Bank says woman’s charges on ex-boyfriend’s account were proper

A bank named in a Troy man’s lawsuit against his ex-girlfriend says the woman’s name was added to his account with his knowledge and any charges on the account were properly charged.

Andrew Harold Schmitt is suing a former girlfriend for allegedly using his identity to empty his bank account and buy a car without his consent.

Schmitt filed a lawsuit April 11 in Madison County Circuit Court against Melissa Turner, U.S. Bank, American Honda Finance Corporation and Bommarito North County Inc., formerly known as Bommarito Honda Inc. United Recovery Systems LP and Monarch Recovery Management Inc. are also named defendants.

U.S. Bank responded to the lawsuit May 22, stating that to the extent the plaintiff asserts any charges to his account were unauthorized, the plaintiff failed to timely review his account activity and notify U.S. Bank of allegedly unauthorized charges, so the plaintiff is now precluded from challenging such charges.

Schmitt says he dated Turner in 2011. According to the complaint, in August 2011, Turner took Schmitt’s social security card and obtained debit card privileges for his U.S. Bank account. Turner then allegedly depleted Schmitt’s account, charged additional purchases to it and left the account with a negative balance.

Turner is also accused of using Schmitt’s name and social security number to buy a 2011 Honda Fit Sport from Bommarito Honda. She allegedly financed the vehicle with a loan from American Honda Finance Corporation taken out in Schmitt’s name.

Schmitt claims he was unaware of the auto loan, the access to his bank account and the negative balance Turner allegedly created until agents of Bommarito Honda and American Honda Finance showed up at his home to repossess the Honda Fit Sport.

Schmitt is represented by attorney David M. Duree of O’Fallon.

St. Anthony’s Health Center denies allegations against it in a woman’s lawsuit against the hospital.

Tiffany Corbin filed a lawsuit April 16 in Madison County Circuit Court alleged that  doctors at St. Anthony’s, where her daughter was born, failed to treat an infection that caused her daughter to suffer permanent brain damage.

St. Anthony’s responded to the lawsuit May 28, stating the hospital is “without sufficient information to admit or deny the allegations” in the complaint.

Corbin claims her daughter, Madalynn, was born June 28, 2012, with Group B Strep and is permanently brain damaged. As a result of her condition, Madalynn Corbin will incur millions of dollars in medical costs in the future and will be inhibited from working, talking, walking, thinking or enjoying her life, the suit claims.

Tiffany Corbin claims Dr. Soldrea Thompson of St. Anthony’s Health Center was treating her throughout her pregnancy, but failed to evaluate or treat Tiffany Corbin for risks of infection while her daughter was in her womb.

St. Anthony’s admits providing medical care to Corbin on June 28 but denies that Thompson was its agent, apparent agent, servant or employee and is without sufficient information to admit or deny the remaining allegations and legal conclusions.

Defendant fires back at plaintiff over alleged ‘errant bullet’ shooting

One of the defendants being accused of firing an errant bullet at a man sitting in his house argues that the plaintiff needs to determine who fired it.

Defendant Brent M. Maseiro filed a motion to dismiss the Madison County personal injury suit on May 23. He and three other defendants, David Chenot, Brandon Gibbons and Frankie Zarantoello, are being sued by Clifford Spickerman.

Spickerman says he was in his home on the 500 block of Strohbeck Lane in July 2011 when his face was grazed by a bullet from a Mosin Nagant rifle. At the time, Maseiro, Chenot, Gibbons and Zarontenello were target shooting in a field at the corner of 80 Street and Walnut Drive in Cottage Hills, about a mile from Spickerman’s house.

Spickerman claims one of the four defendants fired a round from the Mosin Nagant, which he also claims travels great distances. Spickerman accuses the men of negligence for reckless discharge of a firearm without a suitable barrier to prevent bullets from leaving the area.

In Masiero’s motion to dismiss, he claims he cannot determine who fired the bullet and if the plaintiff is unable to determine who fired the bullet, he does not have a cause of action.

“The plaintiff has to allege that the defendant himself discharged the weapon and that the bullet that fired from the weapon when he discharged it was the bullet that struck the plaintiff,” the motion to dismiss states.

Motorcyclist alleges he was rear-ended by intoxicated driver

gavelA motorcyclist claims he was rear ended by a drunk driver while stopped at an intersection in Ft. Russell Township.

Cody E. Heflin filed a lawsuit against Nicole A. Parker May 31 in Madison County Circuit Court.

Heflin says he was riding a Suzuki motorcycle south on St. James Drive in June 2011 and stopped at the intersection of Illinois Route 140. According to the complaint, Parker was also driving south on St. James Drive but says she did not see Heflin’s motorcycle. Heflin claims he was hit from behind by Parker, thrown into her windshield and onto the ground. Heflin accuses Parker of being intoxicated at the time of the crash.

Heflin accuses Parker of negligence and asks for more than $15,000 in damages for medical expenses, loss of income and court fees.

Attorney Michael R. Glenn of Nokomis represents him. They request a jury trial.

Wood River nursing home sued on wrongful death claim

A Wood River nursing home is blamed for the death of a resident who was there for care following a surgery.

Brenda Schneedle, as special administrator of the estate of Nellie Petrokovich, filed a lawsuit May 30 in Madison County Circuit Court against SA-Enc VIP Manor LLC, doing business as VIP Manor, SA-Enc Operator Holdings LLC, Dr. Louis Gary, Katherine M. Stieb A.N.P. and General Medicine of Illinois Physicians P.C., doing business as General Medicine P.C. General Medicine of Illinois Nurse Practitioners P.C., doing business as General Medicine P.C. are also named as defendants.

In May 2011 Petrokovich underwent colon surgery at St. Anthony’s Hospital, according to the complaint. She was discharged and transferred to VIP Manor the following month in stable condition. During her time at VIP Manor, Petrokovich’s family says she was under the care of Dr. Gary, nurse Stieb and the staff of the nursing home.

The lawsuit claims blood work was ordered for Petrokovich and the results of the tests were subsequently faxed to VIP Manor. The lab results allegedly showed Petrokovich had low sodium levels in her blood. However, nursing home records show no indication staff ever received the fax nor were there any physician’s orders for that day.

Within days of the low sodium levels being detected, Schneedle says Petrokovich began to show swelling in her arms, legs, feet and face and was taken to St. Anthony’s emergency room for care. She was released two days later and moved back to VIP Manor, according to the lawsuit.

That same day the nursing home staff allegedly noticed Petrokovich had shortness of breath, slurred speech and was confused. Schneedle says Dr. Gary was called and Petrokovich was taken back to St. Anthony’s Hospital where she was diagnosed with respiratory distress and congestive heart failure. Petrokovich remained at the hospital until she died eight days later.

Schneedle, Petrokovich’s daughter, accuses the nursing home, its owners and staff of negligence for failing to take the appropriate measures to prevent the decline of Petrokovich’s condition. She also accuses them of Illinois’ Nursing Home Care Act violations and wrongful death.

Schneedle asks for an unspecified amount of money in damages and court costs. She is represented by attorney Jaye Richard Lindsay of Chicago.

A Bethalto woman says she was hurt when the car she was riding in was hit head-on by another driver.

Heather M. Gobble filed a lawsuit May 31 in Madison County Circuit Court against Marilyn S. Meisenheimer.

Gobble says she was a passenger in a car going south on Logan Street in June 2011. Meisenheimer was heading north on Logan Street, according to the complaint, crossed the center line and crashed into car Gobble was riding in.

Gobble accuses Meisenheimer of negligence and asks for more than $50,000 in damages for medical bills, lost wages and court costs.

Attorney Bob L. Perica of Wood River represents Gobble.
