Defendant in fatal apartment fire suit wants judge to enforce discovery agreement

A Roxana property owner fighting a Madison County wrongful death lawsuit is asking the Court to force one of the plaintiffs to respond to interrogatories and requests for production.

Dawson M. Cooper was sued last year by Tiffany Gresham and Toni Leeds, as special administrator of the estate of Gresham’s children – Skye Nichole Gresham and Jason Matthew Gresham II – who perished in a Feb. 5, 2011 apartment fire. The plaintiffs blame Cooper for allowing a faulty stove to remain on the premises and for not having properly working smoke and carbon monoxide detectors, among other things.

Gresham’s boyfriend Michael Macarthy, who lived at the apartment at the time of the fire, was later allowed to intervene in the case as a plaintiff.

Cooper claims that Macarthy has failed to comply with an agreement to supplement discovery answers by May 2.

Attorneys William B. Starnes, II and Jennifer M. Wagner of Reed Armstrong Mudge & Morrissey in Edwardsville represent Cooper.

Macarthy is represented by John Anderson and Andrew Martin of Anderson & Associates in St. Louis.

Gresham is represented by Ryan Mahoney of Swansea.

In a May 14 filing, Cooper’s attorneys state that Macarthy objected to the following questions by arguing they were overbroad, unduly burdensome and irrelevant:

“Have you suffered any personal injury or serious illness since the date of the occurrence? If so, describe the injury or illness, the date when experienced and the names and addresses of persons treating you therefore.

“Please give the names and addresses of all medical doctors or any person who has treated or examined the plaintiff for any physical or mental condition other than the alleged injuries in the past 15 years, and after each name list the condition for which treated or examined.

“Please give the names of any hospitals or institutions to which the plaintiff was admitted, or in which the plaintiff received treatment or examination, for something other than the alleged injuries in the past 15 years and after each name, list the condition for which treated or examined, and the date of such treatment or examination.”

Cooper also sought all investigative reports of police or other investigators pertaining to allegations in the lawsuit, to which Macarthy responded: “Information is equally available to Defendant.”

And, Cooper sought copies of Macarthy’s state and federal income tax returns for the past five years. Macarthy responded that the request was overly broad and harassing.

Cooper states that as of May 10, he has not received Macarthy’s supplemental responses, despite an agreement to do so.

Religious discrimination suit against Aaron’s removed to federal court

A Madison County religious discrimination suit against an East Alton rent-to-own store has been removed to federal court.

Ralph Calame Jr. sued Aaron’s Inc. on April 1 claiming he was unlawfully fired for his religious beliefs in March 2012.

Calame worked for Aaron’s and was treated well until his regional manager found out he was a pastor in a church, the complaint alleges. After learning about his work with the church, Calame claims the regional manager harassed him at work and eventually fired him in March 2012.

Calame contends Aaron’s violated the federal Civil Rights Act of 1964. He asks for more than $50,000 in damages for lost wages, benefits and costs of the lawsuit.

Attorney Thomas O. Falb of Alton represents Calame.

The removal notice to the Southern District of Illinois shows that attorneys Richard B. Lapp and Kyle R. Hartman of Seyfarth Shaw in Chicago represent Aaron’s.

Hylla denies Grafton Zipline Adventures’ motion to dismiss, allows first amended complaint

Madison County Circuit Judge Dave Hylla has denied Grafton Zipline Adventures’ motion dismiss a suit filed by a woman allegedly injured at the facility’s “Barn Burner” run last October.

Hylla declared the defense motion moot in light of granting plaintiff’s motion to file a first amended complaint.

Plaintiff April Dodge originally filed suit Feb. 15, claiming she was injured when her foot struck a tree trunk at the base of a zip line run. She claims she suffered a broken right heel bone and had to undergo surgery to fix the fracture.

In an amended complaint filed May 3, Dodge added claims of willful and wanton conduct on the part of the company and its employee Michael Quinn saying they acted with reckless disregard for the safety of patrons.

Grafton Zipline and Quinn responded to the complaint last month saying the plaintiff’s claims are barred by an “exculpatory agreement she signed prior to engaging in the ziplining activity.”

Dodge, represented by Jamie L. Boock of Bossiter and Boock in St. Louis, argued against the defense motion to dismiss saying the exculpatory agreement is not enforceable as a matter of law.

“First, zipline courses are statutorily defined as common carriers and as a matter of Illinois public policy, common carriers cannot exempt themselves from liability for their own negligence,” Dodge’s response states.

“Second, the Illinois Legislature has indicated an intention to prohibit the use of exculpatory agreements in the operation of amusement rides by statutorily requiring all amusement ride operators to maintain liability insurance for the bodily injury or death of patrons.”

Dodge also states that Illinois case law holds that a party cannot enforce an exculpatory agreement that purports to waive liability for its own willful and wanton conduct.

According to the complaint, Dodge claims she was unable to brake her descent as she approached the course’s platform. She claims she attempted to brake as instructed by Quinn, but despite her best efforts, the system failed.

Dodge approached the landing platform at a high rate of speed and Quinn was unable to stop her, her suit says. She claims she has been permanently scarred and disfigured and has been caused to suffer fear, stress and anxiety.

She seeks a judgment of more than $50,000.

In Hylla’s May 3 order, he indicated defendants must respond to the first amended complaint with 21 days.

Plaintiff would have 21 days to respond if defendants file a new motion to dismiss. And, defendants would have 14 days to file a reply in support of their motion to dismiss.

MCT and Agency for Community Transit deny liability in disabled woman’s suit

Madison County Mass Transit District (MCT) and the Agency for Community Transit deny liability for a disabled woman’s injuries suffered while she attempted to board a bus in March 2012.

The agency responded to a suit filed in February over injuries Pamela Jo Byrd allegedly suffered after falling backwards from her wheelchair.

Guardians Laverne F. DeMent and Frances E. Abbett claim Byrd suffered a subdural hemorrhage, experienced pain and suffering, incurred medical costs, lost her enjoyment of a normal life and sustained disability. They blame an MCT employee for Byrd’s injuries.

MCT and the Agency for Community Transit also filed affirmative defenses, saying that if they are at all liable, the amount of fault attributable to the defendants is less than 25 percent of the total fault.

The defendants are represented by Donald J. Ohl of Knapp, Ohl and Green in Edwardsville.

Eric J. Carlson of Byron, Carlson, Petri and Kalb in Edwardsville represent the plaintiffs. They seek a judgment of more than $50,000, plus costs and other relief the court deems just.

Circuit Judge Andreas Matoesian presides.

A case management conference is set at 9 a.m. on May 31.

Daycare sued for $100K over child’s fall from fireman’s pole

fireman's poleThe mother of a minor girl has filed suit against the learning center where she claims her daughter fell from a fireman’s pole, causing her to break her arm.

Javon Garrett claims her daughter, A’lon Garrett, was playing at defendant Lilypad Learning Center on Oct. 23, 2012, at about 4:30 p.m. when she was allowed to use a fireman’s pole while unsupervised. When she was playing on the pole, A’lon Garrett fell and severely injured herself, according to the complaint filed May 15 in Madison County Circuit Court.

Because of her tumble, A’lon Garrett was made sick, sore, lame, disordered and disabled; suffered extensive injuries to her head and body; and endured a broken right arm, the suit states. She also endured disability, experienced pain and suffering, incurred medical costs and lost wages, the complaint says.

Javon Garrett blames Lilypad for causing her daughter’s injuries, saying it negligently failed to properly train its employees to supervise children, failed to warn of a dangerous condition and failed to properly supervise A’lon Garrett.

In her complaint, Javon Garrett is seeking a judgment of more than $100,000, plus costs.

John H. Hustava of Collinsville will be representing her.

Challenge Unlimited blamed for slip and fall incident

A woman has filed suit against the Alton business where she claims she tripped on steps while attempting to deliver various documents.

Barbara J. Crum claims she was working for Residential Options and was attempting to deliver a container of file folders to a storage shed at 1017 Oakwood in Alton. Defendant Challenge Unlimited owned the shed where Crum was delivering the folders, according to the complaint filed May 15 in Madison County Circuit Court.

“Residential Options used the shed for storage and accessed it by a sidewalk beginning at the building and ending at concrete steps descending to the entry door of the shed,” the suit states.

Crum blames an unspecified “unsafe” condition on the steps for causing her fall.

Because of her fall, Crum suffered serious and permanent injuries, experienced pain and suffering, incurred medical costs, endured disability and lost her earnings, the suit states.

Crum blames Challenge Unlimited for causing her fall, saying it negligently failed to provide safe premises, allowed an unsafe condition to exist on the steps of the shed, maintained steps that were a nuisance and maintained a set of steps that violated code, among other negligent acts.

In her complaint, Crum seeks a judgment of more than $100,000, plus costs.

ConAgra blamed for peanut butter salmonella poisoning seven years ago

The parents of a girl have filed suit against the peanut butter manufacturer that they claim caused their daughter to contract salmonella poisoning after ingesting the substance.

Lonnie and Penny Hill claim their daughter, Cara Hill, ingested Peter Pan peanut butter, which was purchased from Country Market on or before Nov. 19, 2006. After eating the peanut butter within days of the purchase, Cara Hill became seriously ill, according to the complaint filed May 16 in Madison County Circuit Court.

The Hills allege the peanut butter was contaminated with salmonella, which had caused their daughter’s illness and a permanent condition called ankylosing spondylitis, which is a form of arthritis that affects the spine.

In addition to her injuries and her permanent condition, Cara Hill incurred medical costs, suffered emotionally and physically and lost her normal life while she was attempting to recover from her injuries, the suit states.

The Hills blame ConAgra Foods for contributing to their daughter’s injuries, saying the company manufactured the salmonella-infused peanut butter. They also name Country Market as a defendant, saying it sold the peanut butter to them, failed to inspect it before its sale, failed to timely notify customers of the salmonella issue, failed to timely recall the peanut butter and failed to timely remove the peanut butter from its shelves.

In their three-count complaint, the Hills seek a judgment of more than $300,000, plus costs.

Mechanic sues St. Louis Regional Airport Authority over injuries

An airplane mechanic is suing the owner of the Bethalto airport after he allegedly fell off a jet while working on the engine.

Michael C. Pagano filed a lawsuit May 10 in Madison County Circuit Court against St. Louis Regional Airport Authority.

Pagano says he was working as a mechanic for West Star Aviation in May 2012 and was repairing a plane in one of the hangars at Bethalto airport. According to the complaint, Pagano was standing on the pylon of the jet engine, the area where the engine attaches to the plane, when he slipped and fell ten feet to the concrete floor.

Pagano accuses the St. Louis Regional Airport Authority of negligence for not providing safety harnesses, lanyards or nets to protect employees if they should fall while working on an engine. He asks for more than $50,000 in damages for medical expenses, loss of income and costs of the lawsuit.

Asset Acceptance LLC filed a lawsuit on May 13 in Madison County Circuit Court against Daniel Cook.

Asset Acceptance LLC claims Daniel Cook opened credit card accounts with Citibank and Bank of America and agreed to repay all money borrowed from both companies. According to the complaint, Cook owes Citibank $23,147 and owes Bank of America $35,366 in unpaid credit card debt.

The debt collector accuses Cook of breach of contract for allegedly refusing to make payments to either company as agreed. It is asking Cook to pay $58,513 plus interest and court costs.

Woman claims driver rear-ended vehicle at Bethalto intersection

A Wood River woman claims she was hurt when a Bethalto driver crashed into the back of her.

Tina M. Leader filed a petition against Judy L. Jordan on May 9 in Madison County Circuit Court.

Leader says the crash happened while she was stopped in her vehicle in a westbound turn lane of Illinois Route 140, waiting to turn onto southbound Illinois Route 111. Jordan drove up behind Leader and, according to the complaint, crashed into the back of her vehicle.

Leader contends Jordan was negligent for failing to keep a proper lookout and failing to keep control of the vehicle to avoid a collision. She says the impact of rear-end crash injured her neck, shoulder and arm.

Leader is asking for more than $50,000 in damages plus court costs.

Collinsville Wal-Mart sued over check out lane slip and fall

A Collinsville Wal-Mart and its manager are named in a lawsuit after a customer allegedly slipped on a wet floor.

Marie Odom-Green filed a lawsuit May 10 in Madison County Circuit Court against Wal-Mart Stores Inc., doing business as Wal-Mart Supercenter, and Matt Gehrs.

According to the petition, Odom-Green was shopping at the Collinsville Crossing Boulevard Wal-Mart in May 2012 when one of the store’s employees found a slippery substance in a check-out lane. Odom-Green claims the employee called for help to clean up the area but did not put up any warning cones. The same employee allegedly continued to check-out customers in the lane with the wet floor.

Odom-Green says when she entered the check-out lane she slipped on the floor and fell, hurting her right knee. She accuses the store and the manager, Gehrs, of negligence for failing to clean up the floor in a timely manner and not informing customers of the dangerous condition in the check-out lane.

Odom-Green asks for more than $100,000 in damages for medical expenses, lost wages and court costs.

She is represented by attorney Michael P. Glisson of Alton.

Estate of 91-year-old sued over Godfrey crash

A woman is suing the estate of a man who she claims pulled out in front of her and caused a crash in Godfrey.

Susan M. Merriman filed a lawsuit May 13 in Madison County Circuit Court against the estate of Christian F. Veltjes. John W. Hoefert Jr. is named as executor.

Merriman says she was driving a GMC Envoy north on Godfrey Road in August 2012. As she entered the 5300 block of Godfrey Road, Merriman says Veltjes pulled out of the Moto Mart parking lot into the northbound lane. Merriman contends Veltjes drove directly in front of her making it impossible to avoid crashing into his car. The 91-year-old Veltjes died injuries he received in the crash, according to the complaint.

Merriman accuses Veltjes of failing to yield to oncoming traffic and is suing his estate for negligence. She asks for more than $50,000 in damages for medical bills, lost wages and court fees.

Attorney Bruce A. Beeman of Springfield represents Merriman. They request a jury trial.

A convicted murderer has filed a post-conviction petition in Madison County Circuit Court, claiming that the state’s attorney’s office engaged in prosecutorial misconduct that merits his acquittal.

In his recently filed petition, Jeramey Brown asserts that the alleged pattern of prosecutorial misconduct violated his constitutional rights and as such, should result in an outright acquittal, or in the alternative, a new trial.

ng, systemic prosecutorial misconduct,” Brown alleges in his petition. “The State, beginning … in 2001, and continuing on throughout the entirety of these proceedings, has refused to operate within the ethical and legal boundaries of the criminal justice system.”

In 2003, Brown was found guilty of murdering Michael W. Keller of Granite City during a botched burglary at his home in April 2001.

After the appellate court in 2005 reversed his conviction and remanded for a new trial, Brown, who presented an alibi defense at both of his trials, was again found guilty of Keller’s murder in 2008 and sentenced to 75 years in prison.

The appellate court in a 2012 unpublished order affirmed Brown’s conviction and later that year, denied his petition seeking rehearing and a motion to vacate and reassign the matter. The Illinois Supreme Court last year denied his motion for a supervisory order.

Brown claims in his petition for post-conviction relief that “since the moment he was arrested, he has fought to prove his innocence.”

“Little did he know, the State was not only engaging in systematic misconduct, but was also listening to recorded phone calls and reading copies of legal mail between Jeramey and his defense lawyer, ensuring that Jeramey would in no way received a fair trial in Madison County.”

Brown’s allegations of prosecutorial misconduct were brought up last year by Hamel attorney Thomas Burkart in his unsuccessful judicial campaign against Circuit Judge Kyle Napp.

He claimed that Napp –who assisted in the prosecution of Brown, but was serving as an associate judge by the time his case went to a second trial –mishandled Brown’s prosecution.

Among other things, Burkart told The Record in November 2012 that he took issue with what he says was illegal wiretapping of Brown’s phone calls to his attorney and the reading of his mail while he was in jail.

Burkart told The Record that he raised the issue because it went to the “competency” of his opponent, saying “she was either knowingly doing something wrong or she was not competent to know.”

In response to Burkart’s claims, Napp told The Record that Burkart’s campaign strategy of bringing up Brown’s case was “disgraceful.”

She said nothing illegal was done in the handling of Brown’s prosecution and said that by law, the State can record phone conversations and read some mail.

Napp said prosecutors had been shown letters that Brown had sent from jail to his family that indicated he was attempting to intimidate witnesses. She also said that “nobody ever listened to conversations of Jeramey Brown and his lawyer.”

Brown asserts in his petition for post-conviction relief that the “State’s purposeful intrusion” into his “communications with his attorney before, during, and after his criminal trial, is sufficient alone to warrant a new trial.”

In violation of his Sixth Amendment right to counsel and due process, Brown claims that the state was able to hear him and his attorney “discuss his alibi, investigative leads, potential witnesses, and defense strategy,” an intrusion he asserts “amounts to a bald disregard for the adversary system and warrants a new trial.”

His petition further asserts that “Madison County jail policies on telephone use are silent as to attorney-client phone calls, and as a result of these unwritten practices, Mr. Brown has successfully obtained a civil settlement due to the monitoring of his priveileged attorney-client communications.”

In addition to allegations of prosecutorial misconduct, Brown claims he is entitled to post-conviction relief because he was denied due process on appeal based on “a grave and improper conflict of interest” and because he “is actually innocent, as shown by newly discovered evidence that the State’s key witness falsely implicated him.

Brown’s petition, which seeks acquittal or a new trial, also asks the court to docket his petition for further proceedings, grant his accompanying motions for discovery and change of venue or appointment of an un-conflicted prosecuting agency, and hold an evidentiary hearing on the merits of his petition.

Chicago attorneys Amanda N. Graham and Katie J. Kizer submitted the petition on Brown’s behalf.

Godfrey intersection accident results in injury suit

car crashA driver is asking to be paid more than $50,000 after crash at a Godfrey intersection.

Schelley Lyons, also known as Schelley Walker, filed a complaint on May 3 in Madison County Circuit Court against Kyle Kinder.

The crash happened on May 5, 2011, according to the lawsuit, at the intersection of Godfrey Road and Enos in Godfrey. Lyons says she was driving a 2001 Ford Escort while Kinder was behind the wheel of a 2002 Grand Prix driving toward her.

Lyons claims Kinder lost control of his car and crashed into the Escort she was driving. She says she was hurt in the crash and is asking to be paid more than $50,000 in damages.

Tyson Foods and driver blamed for failing to stay in I-270 lane

A woman claims she suffered a fractured ankle after a truck driver failed to stay in his lane and struck her vehicle.

Erin Arman filed a lawsuit May 13 in Madison County Circuit Court against Terry Wayne Randall and Tyson Foods.

In her complaint, Arman alleges she drove east on Interstate 270 near mile post 4 on March 27, 2012, when Randall, who was driving in the same direction, struck her vehicle after he failed to remain within the confines of his lane.

Because of the collision, Arman sustained injuries including a torn right rotator cuff and a fractured ankle and left hand, and experienced pain, suffering and disability, according to the complaint. She also incurred medical costs of about $69,629.09, lost wages, experienced an impaired earning capacity and suffered a diminished capacity to enjoy life, the suit states.

Arman blames Randall for causing the collision, saying he negligently failed to keep a careful lookout, failed to yield the right-of-way, changed lanes when it was not safe to do so and failed to keep his vehicle within its lane.

Arman also names Tyson Foods as a defendant, saying Randall was driving a tractor trailer for the company when the incident occurred.

In her two-count complaint, Arman seeks a judgment of more than $100,000, plus costs and other relief the court deems just.
