Canadian passenger sues over injuries sustained in Centralia accident

A man from Ontario, Canada, says his pelvis and leg were broken when the car he was riding in turned in front of another car in Centralia and crashed.

Dennon Koziol filed a lawsuit April 26 in Madison County Circuit Court against Dain H. Burress, Lawrence M. Miller and Heneghan & Associates P.C.

Koziol was a passenger in a car being driven by Burress in April 2011. According to the complaint, they were heading north on Shattuc Road near Kaskaskia College. Koziol says Burress tried to make a left turn into the entrance of an apartment complex across from the campus. However, at the same time, Miller, working for Heneghan & Associates, was driving south on Shattuc Road. Koziol claims Burress did not use his turn signal prior to turning in front of Miller. The passenger says Miller’s vehicle collided with Burress’ car.

Koziol says the impact of the crash caused him to break his leg in multiple places along with his pelvis, injuries he contends cost him in excess of $210,000. He accuses Burress, Miller and the civil engineering company of negligence and asks for more than $150,000 in damages for medical expenses, loss of income and court costs.

Attorney James P. Leonard of St. Louis represents Koziol. They request a jury trial.

Illinois Central worker claims chemical exposure caused kidney cancer

A former employee of a Madison County railroad company says his nearly 40 years of exposure to chemicals while on the job gave him cancer of the kidney.

William Grammer filed a lawsuit April 23 in Madison County Circuit Court against Illinois Central Railroad.

Grammer worked for Illinois Central Railroad from February 1972 through February 2011. During that time, he says he performed several jobs including switchman, brakeman, conductor and yardmaster in Madison, Marion and Franklin Counties.

Throughout the course of his employment Grammer claims he was exposed to harmful and hazardous chemicals and fumes. Those chemicals allegedly included diesel exhaust and fumes, asbestos, creosote, chlorinated hydrocarbons, pesticides and herbicides, according to the petition. Grammer contends he was required to work around the harmful chemicals and agents without proper respiratory equipment. Because of this, Grammer claims he was diagnosed with kidney cancer in January 2011.

He accuses the railroad company of negligence and of violating OSHA regulations and the Federal Employers’ Liability Act for allowing him to work in an unsafe environment. Grammer asks for more than $50,000 in damages for medical expenses and costs of the lawsuit.

Attorneys Patrick S. O’Brien and Jeffrey E. Chod, of St. Louis, represent Grammer. They request a jury trial.

GRP Mechanical sues two insurers over work comp denials

Two Madison County insurance companies are accused of denying workers’ compensation coverage to an employee of a Bethalto mechanical company.

GRP Mechanical Company Inc. filed a lawsuit April 22 in Madison County Circuit Court against Consolidated Construction Safety Fund of Illinois and Seabright Insurance Company.

According to the complaint, Michael Rizzi worked for GRP Mechanical and filed workers’ compensation claims in 2010 against the company for alleged accidents in 2007 and 2009. GRP says it had workers’ compensation coverage with CCSFI in 2007 and Seabright in 2009 and 2010.

GRP says it submitted both of Rizzi’s claims to Seabright but the insurance company argued to an arbitrator that Rizzi’s 2007 injuries occurred while he worked for a previous employer, thereby releasing Seabright from liability. The arbitrator allegedly agreed with that argument but the decision was later overturned by the Workers’ Compensation Commission in February 2012.

Subsequently, Seabright denied coverage in June 2012 so GRP submitted the claim to CCFSI. However, CCFSI allegedly listed late notice as the reason for denial in August 2012 even though no judgment held that coverage was lacking.

While its insurance claims were being denied GRP says it appealed those decisions to Madison County Circuit Court, which affirmed the judgment in January. In February, GRP settled Rizzi’s claim for more than $151,000.

GRP accuses CCFSI of breach of contract and accuses Seabright of denying coverage of GRP’s employees. The company asks for more than $200,000 in damages and court costs.

The plaintiff is represented by attorneys Christopher W. Byron and Christopher J. Petri of Edwardsville. They ask for a jury trial.

Troy McDonald’s sued over girl’s alleged ‘playland’ injuries

playlandThe father of a Madison County girl says his daughter was hurt while playing at a McDonald’s in Troy.

Eric Wakefield, on behalf of his minor daughter, filed a lawsuit April 22 in Madison County Circuit Court against McDonald’s Restaurants of Illinois Inc.

Wakefield says his daughter was climbing on the play set of the McDonald Drive McDonald’s in July 2012 when she tripped and hit her face on the structure.

Wakefield accuses the restaurant of negligence for failing to maintain a safe play environment. He asks for more than $50,000 in damages for medical expenses and court fees.

Attorney Gregory Tobin of East Alton represents the Wakefields.

Madison County Circuit Judge Dave Hylla was elected today as the Third Judicial Circuit’s new chief judge.

Hylla will take over for Judge Ann Callis, who has been chief judge since 2006 and made headlines this month over speculation that she is considering a run for the 13th Congressional District.

“I am honored that my colleagues have placed their confidence and trust in me to be the next Chief Judge,” Hylla said in a statement issued today by the chief judge’s office. “We have a very fine team of Judges and I look forward to working with all of them to serve the people of Madison and Bond Counties by continuing to provide an efficient, fair and impartial Court system”.

Hylla thanked Callis for her more than 18 years of service on the bench in the statement, saying she helped the circuit institute “many important and innovative programs including Veterans’ Court and Residential Mortgage Foreclosure Mediation” during her tenure as chief judge.

The statement made no mention of Callis’ alleged bid for Congress,  but the Edwardsville Intelligencer reported that she announced she would step down from the bench to run for Republican Rodney Davis’ Congressional seat at today’s Madison County Judiciary Committee.

Callis could not immediately be reached for comment.

Prior to joining the bench, Hylla served in private practice for 21 years and worked as the city attorney for Madison and Venice, as well as legal counsel for Service Employees International Union Local 98.

During his time as a circuit judge, Hylla was chief judge of the Civil Division and chairman of the committee that established the Medical Malpractice Mediation program.

Congressional race in 13th likely to be competitive and costly

Campaign cash has already begun pouring into a southern Illinois battleground for control of the U.S. House of Representatives in 2014 – a congressional district that could feature a prominent Madison County public figure as challenger.

Incumbent U.S. Rep. Rodney Davis (R-Taylorville), who was first elected to the 13th Congressional District in November, has raised$403,555 through March 31, according to campaign finance records.

And while his potential opponent, Madison County’s former Chief Judge Ann Callis has not officially announced her intention to run for Congress, she has stepped down from her role as judge five months after winning retention to a six-year term. Callis told employees at the courthouse on Friday she would be resigning effective May 6.

During the last campaign cycle, Callis self-funded her campaign with approximately $144,000. She also self-funded previous retention efforts.

The 13th Congressional District is a successor to the old 15th Congressional District which has traditionally leaned Republican, but through redistricting is considered more of a toss-up.

The district covers parts of Bond, Champaign, Madison, McLean and Sangamon counties and all of Christian, Calhoun, DeWitt, Greene, Jersey, Macon, Macoupin, Montgomery and Piatt counties.

In last year’s race, Davis narrowly defeated Democrat David Gill by a margin of 46.6 to 46.2 percent, or 1,002 votes. Approximately $9.6 million was raised in that election, which averaged about $32 per vote.

President Barack Obama lost in the 13th by three-tenths of a percent. Obama had won in all five of the state’s contested districts.

 

 

Former partner of Athletes in Action sues over loss of interest

scales of justice2A former minority member of an exercise company claims his superiors wrongly accused him of criminal activity, then proceeded to illegally take his interest in the company.

Steven W. Friederich filed a lawsuit April 26 in Madison County Circuit Court against Vern Vanhoy, Lauren Vanhoy, Athletes in Action doing business as Nautilus and Athletes in Action Building.

In his complaint, Friederich alleges he was a minority member of Athletes in Action while the Vanhoys were majority members of the company. However, the Vanhoys allegedly began hiding accounting statements from Friederich and have accused him of engaging in unspecified illegal actions. They have also allegedly attempted to steal Friederich’s interest in the company, according to the complaint.

Friederich insists that the Vanhoys have made unfounded and untrue accusations that he was engaging in criminal activities and that he had a gambling addiction. In turn, they have wrongly attempted to take his majority interest in the company, the suit states.

In fact, Friederich says the Vanhoys are improperly disbursing money within the company and inappropriately managing the company.

“The self-serving, unlawful and improper conduct engaged in by the majority members and engaged in by the managing member include, but are not limited to, failing to properly provide notice to all members of meetings of the LLCs, failure to properly conduct meetings of the members of the LLCs, diversion of the LLCs’ assets to the individual benefit of the managing member and his family, and conversion and/or attempted conversion of plaintiff’s interests in the LLCs to majority members,” the complaint says.

“Vern Vanhoy hired and employed family members and compensated family members at a level of compensation greater than the compensation paid to other individuals who were not family members but who provided the same or more valuable services to the LLCs.”

The Vanhoys have been attempting to convert Friederich’s portion of the company to themselves since October 2010, but reversed course in December 2010, he claims.

At some point between then and April 2012, however, the Vanhoys succeeded in taking Friederich’s interest in the company, which is illegal, according to the complaint.

After Frederich learned of his loss of interest in the company from his tax preparer, he demanded his ownership interest be returned, the suit states. Still, the Vanhoys refuse to comply with his request.

Now, he says the Vanhoys are breaching their fiduciary duty to him.

In his complaint, Friederich is asking the court to order the Vanhoys to provide him with a complete accounting of all of Athletes in Action’s assets and liabilities from 2005 through the present. He is also seeking an order that a natural receiver be appointed and an order that the assets of the LLCs be distributed in a fashion the court deems just.

Friederich seeks the full value of the property taken by defendants, an order that the defendants return the property to him, an order to prevent the defendants from taking or asserting control over his property in the future and significant punitive damages, plus additional relief the court deems just.

Edwardsville cop sues over attack at Big Daddy’s

big daddysAn Edwardsville police officer who was attacked by an intoxicated patron at an Edwardsville bar seeks nearly $500,000 for the incident.

Andrew J. Feller and his wife, Kimberly Feller, filed a lawsuit April 29 in Madison County Circuit Court against BubbaSliceBone doing business as Big Daddy’s Edwardsville, Steven J. Siebert, Timothy J. Bauer, James J. Sinovic Jr., Arthur Risavy and Traig Henson.

In their complaint, the Fellers allege Edwardsville police officer Andrew Feller had been called to Big Daddy’s Edwardsville on April 29, 2012, to attempt to break up an altercation in the bar’s parking lot. Henson had been visiting the bar, where he became intoxicated, according to the complaint.

“That as a direct and proximate result of the intoxication, and without provocation of any kind by Feller, co-defendant Traig Henson then maliciously and wantonly assaulted and attacked Feller, striking him and violently holding onto him, on and about his back, torso, knee and other musculature,” the suit states.

Because of the incident, Andrew Feller became sick, sore, lame and disordered; experienced pain and suffering; and incurred medical costs, the complaint says. He also claims he suffered disability, lost wages and lost his earning capacity.

Due to her husband’s injuries, Kimberly Feller has been deprived of his society, companionship, love, affection and support, according to the complaint.

The Fellers name Siebert, Bauer and Sinovic as defendants, saying they owned the bar where Andrew Feller was attacked. Risavy leased the premises to the bar’s owners.

They also named the bar as a defendant, saying it permitted its patrons to become intoxicated and disorderly, failed to control is patrons, did not take reasonable affirmative action to protect against the misconduct of individuals, sold alcoholic beverages to Henson when it knew he was intoxicated, failed to prevent harm to its patrons when it knew Henson was intoxicated and failed to warn its patrons of Henson’s disorderly conduct.

In their complaint, the Fellers seek a judgment of more than $400,000, plus costs and other relief the court deems just.

Troy Super Valu patron claims worker videotaped her in restroom

scales of justice2A Highland woman is suing a Troy Super Valu store and a worker she claims used his cell phone to video tape her in the women’s restroom.

Plaintiff Ann Gray says the incident occurred at the store located at 523 Troy Plaza on July 16, 2011, according to the complaint filed May 2 in Madison County Circuit Court.

Gray claims the defendant, Schuette Stores, Inc., failed to discover that its employee Jonathan D. Spotanski was taking pictures of her through a hole in the ceiling of the restroom.

Spotanski also is named as a defendant.

Gray claims she suffered and continues to suffer extreme mental injuries and anguish.

Her suit seeks in excess of $50,000 in damages.

Gray is represented by Adam E. Berry of Beatty & Motil of Glen Carbon.

Laborer sues over retaliatory discharge claims

A laborer formerly employed at Odesco Industrial Services in South Roxana is suing on claims of retaliatory discharge.

According to a complaint filed May 2 in Madison County Circuit Court, Charles Seehausen, Jr. suffered a crushed right hand while loading pipe. Seehausen claims the incident happened on March 30, 2010, which was less than two weeks from the date he began working for Odesco.

He claims that after he was treated for the injury his employer began to harass him and subjected him to disparate treatment in retaliation for his filing workers’ compensation benefits.

The suit also states that on or about Dec. 1, 2010, Seehausen reported to his supervisor that he had slipped and fell, injuring his knee.

He claims he was terminated from employment on Dec. 3, 2010.

Seehausen seeks in excess of $50,000 in damages.

Truck driver sues bus driver over I-70 accident

A truck driver has filed suit against the bus driver who he claims caused him injuries after striking his overturned tractor trailer.

Phillip Carter claims he was driving a semi-trailer west on Interstate 70 in Otego on Aug. 11, 2011, when he attempted to avoid a deer. While swerving, Carter lost control of his vehicle, causing it to overturn and to partially block the left-hand lane.

Other drivers of passing vehicles noticed Carter’s overturned semi-trailer and offered assistance. Two other semi-tractor trailer drivers pulled their vehicles to the side of the road, engaged their emergency flashers and helped Carter with his semi, according to the complaint filed April 29 in Madison County Circuit Court.

However, defendant Rodney McClure, who was driving a Prevost tour bus on the same road, failed to avoid Carter’s vehicle and struck it while two other people were attempting to assist him, the suit states.

As a result, Carter suffered back, neck, hand and rib injuries; experienced great pain and mental anguish; suffered disability; and lost his normal life, the complaint says. He also claims he incurred medical costs.

McClure negligently failed to keep a proper lookout, failed to stop in time to avoid a collision, failed to keep his vehicle under proper control, failed to provide a proper signal to warn of his impending approach, failed to reduce his speed to avoid a collision and drove without safe brakes, according to the complaint.

An Effingham County woman claims she sustained serious injuries in a collision after a driver failed to yield the right-of-way.

Donna R. Denton filed a lawsuit April 29 in Madison County Circuit Court against Allison E. Lutz.

In her complaint, Denton alleges she rode in a 2009 Chevrolet Tahoe that was traveling north on Illinois Route 4 at about 3 p.m. near its intersection with Rose Road in St. Jacob. At the same time, Lutz drove her 1997 Honda Civic east on Rose Road when she approached a stop sign, according to the complaint. However, Lutz failed to obey the traffic signal and struck Denton’s vehicle, the suit states.

Because of the collision, Denton experienced pain and suffering, incurred medical costs, experienced permanent disfigurement and disability and lost wages and her enjoyment of life, the complaint says.

Denton blames Lutz for causing the collision, saying she negligently failed to obey a stop sign, failed to yield to Denton’s vehicle, failed to keep her vehicle under control, failed to decrease her speed to avoid a collision and failed to exercise reasonable care.

In her complaint, Denton is seeking a judgment of more than $50,000, plus costs.

Driver sues motorcyclist after collision with airborne bike

A woman has filed suit against the motorcycle driver who she claims caused her to violently collide with the bike after he caused it to become airborne.

Lori A. Schmidt claims she was riding on a motorcycle defendant Roger D. Schmidt was driving south on Bluff Road near its intersection with Route 156 near Old Valmeyer on Aug. 19. Roger Schmidt failed to obey a stop sign, then left the roadway and entered a graveled, abandoned road, according to the complaint filed April 30 in Madison County Circuit Court. His motorcycle then became airborne and Lori Schmidt was “caused to violently impact” it, the suit states.

Because of the incident, Lori Schmidt suffered severe fractures to her spinal column that required immediate surgery and suffered great pain and anguish, the complaint says. She also claims she incurred medical costs and lost income and her normal life.

Roger Schmidt negligently failed to obey a traffic control device, failed to reduce his speed to avoid leaving the road and drove too fast, according to the complaint.

At the time of the collision, Lori Schmidt had insurance through defendant Country Preferred Insurance Company, which promised to pay her $250,000 for each occurrence. However, when Lori Schmidt submitted a claim for the motorcycle accident, Country refused to comply with the terms of its own policy, the suit states.

Country “vexatiously delayed the settlement of her claim in that it offered the plaintiff less than one-third of the amount of her medical bills when it knew or should have known that the plaintiff was severely injured requiring extensive surgeries and medical treatment,” the complaint says.

She claims the insurance company also failed to investigate witnesses to the collision besides Roger Schmidt and failed to inspect the site of the accident.

In her two-count complaint, Schmidt seeks a judgment of no less than $100,000, plus punitive damages, costs and other relief the court deems just.

Woman alleges brother forged her signature before he died

A recently deceased man has caused a fiasco after he forged a signature on a document that purportedly conveyed his sister’s interest in a piece of property to him, according to recently filed court documents.

Jane Childerson filed a lawsuit April 30 in Madison County Circuit Court against Phyllis Langenhorst, Donald R. Johannes, George Marron, Johannes and Marron, the Estate of Kenneth R. Childerson and the unknown owners of the contested piece of land.

In her complaint, Jane Childerson alleges she and her brother became co-owners of a Bond County piece of property, not including the mineral rights on the property, when two people named Edward R. and Irene O. Wegmann transferred it to them.

Without Jane Childerson’s knowledge, her brother, Kenneth Childerson, forged her signature on a quit claim deed, which conveyed Jane Chidlerson’s interest in the property to him, according to the complaint. Langenhorst, who was working for Johannes and Marron, notarized the signature, the suit states.

It was not until recently, after her brother’s death, that Jane Childerson learned of his actions, the complaint says.

She seeks actual damages from Langenhorst, who she claims breached her legal duty by failing to ensure that the signature she was endorsing was valid, and from Johannes and Marron, who failed to properly supervise Langenhorst, according to the complaint.

She also wants the court to declare the quit claim deed void and to restore her interest in the property. In addition, she seeks compensatory and punitive damages and other relief the court deems just.

Optometrist accused of failing to diagnose fatal ocular melanoma

The surviving spouse of a recently deceased man blames her husband’s eye doctor for contributing to his death, saying the optometrist failed to diagnose his cancer.

Cindy Heflin filed a lawsuit April 29 in Madison County Circuit Court against Rosenthal Optometric Associates and Kimberly Rosenthal Tinge.

In her complaint, Cindy Heflin alleges her recently deceased husband, Kurt B. Heflin, died because of a metastatic melanoma on Nov. 20. She blames her husband’s death on his optometrist, Tinge, who failed to diagnose him with the ocular melanoma that killed him, according to the complaint.

Before his death, Kurt B. Heflin experienced pain and suffering, lost earnings and incurred medical costs, the suit states.

Since Kurt B. Heflin’s death, his wife has lost his support, care, love and affection, the complaint says.

In her complaint, Cindy Heflin seeks a judgment of more than $100,000.
